The Egg Bandits Made a Thousand Times the Fine They Just Paid for Price Fixing

The Egg Bandits: When Price Fixing is a Profitable Business Model

The "Stringer Bell rule"—the notion that the risks of crime should outweigh the rewards—has been rendered obsolete. Under the current regulatory climate, major egg producers have essentially been given a pass for what appears to be a blatant, multi-year conspiracy to fleece consumers.

The Settlement

Recently, the DOJ Antitrust Division and 18 states finalized decrees with the three titans of the American egg industry:

  • Cal-Maine
  • Versova
  • Hickman’s Egg Ranch

The core allegation is straightforward: these companies engaged in a "naked conspiracy" to artificially inflate egg prices between 2022 and 2025. The evidence is reportedly "stone cold," consisting of direct communications—emails and texts—between CEOs coordinating their price hikes.

The Perfect Smoke Screen

The timing of this conspiracy was not accidental. It coincided exactly with a devastating avian flu outbreak that decimated poultry populations.

"It's just a supply disruption, an 'act of God' type of situation." ←\leftarrow← This was the industry line.

In a previous investigative series titled Hatching a Conspiracy, Basel Musharbash argued that the flu was merely a veil. The real driver was market consolidation, which gave a few powerful players the leverage to exploit a crisis. Cal-Maine, acting as the industry "bellwether," played a central role in this dynamic.

The "Expert" Consensus vs. Reality

While the average consumer felt they were being scammed, the "intellectual" class defended the price hikes.

During the 2024 campaign, Kamala Harris suggested that price gouging was fueling inflation. She was immediately shut down by Democratic-aligned economists. Jason Furman, formerly of the Obama administration, argued:

“Egg prices went up last year — it’s because there weren’t as many eggs... there is a risk that policies meant to curb corporate price gouging could instead keep the economy from adjusting.”

Furman and others, including Matt Yglesias (who dismissed the theory as "slopulism") and the Cato Institute, insisted that supply and demand were the only factors at play. Even philanthropist John Arnold took to X (formerly Twitter) to mock the idea of a cartel:

"It’s almost as if egg prices are set by market forces including supply shocks and not by a producer cartel that decides how much to gouge consumers."

How the Scam Actually Worked

To understand the manipulation, one must understand the two-tiered nature of the egg market.

  1. The Big Market: Long-term contracts between producers and giants like Walmart (which buys ~28% of Cal-Maine's output).
  2. The Small Market: The Egg Clearinghouse, an electronic exchange for "spot market" (surplus) eggs.

The "Big Market" prices aren't set by direct negotiation, but by a benchmark provided by a company called Urner Barry. Urner Barry analyzes the trades in the small market to estimate regional prices.

By colluding to push up prices in the small Egg Clearinghouse market, the bandits forced the Urner Barry index higher. Because the massive contracts with Walmart are tied to these formulas, a small manipulation of the index resulted in billions of dollars in extra profit.

This is a classic "benchmark manipulation" scheme, mirroring the infamous LIBOR scandal where banks rigged the base interest rate for global loans.

The Aftermath

The conspiracy ended not because the flu vanished, but because the threat of legal action became real. Once the DOJ stepped in, prices plummeted.

The financial reality of the settlement is staggering. If we look at the ratio of illegal gains to the penalty:

Profitability Ratio=Illegal Gains from Price FixingGovernment Fine≈1,000:1\text{Profitability Ratio} = \frac{\text{Illegal Gains from Price Fixing}}{\text{Government Fine}} \approx 1,000:1Profitability Ratio=Government FineIllegal Gains from Price Fixing≈1,000:1

Conspiracy Checklist:

  • Use a natural disaster (Avian Flu) as cover.
  • Collude via private texts/emails.
  • Manipulate a third-party benchmark (Urner Barry).
  • Get "expert" economists to defend the price hikes.
  • Pay a fine that is a fraction of the profit.
